Governor Roel Degamo confirmed that the Sandiganbayan acted in favor of his motion and dismissed the graft charges against him.
The governor was charged for graft and corruption for the inclusion of the P 10 million worth of intelligence fund in his budget proposal for 2013.
His criminal liability was extinguished due to the absence of a Notice of Disallowance from the Commission on Audit after Degamo settled the amount following the issuance of a mere Notice of Suspension.
Finally, the Sandiganbayan believes that the Office of the Ombudsman caused inordinate delay in the handling of Degamo’s case resulting in the “denial of the constitutional right of Degamo to due process.”
Degamo submitted a proposed budget in 2013 that included P10 million for intelligence fund but the Sangguniang Panlalawigan dominated by the opposition deleted the proposed appropriation.
Degamo eventually vetoed the budget and claimed it re-enacted the P 10 million intelligence fund and proceeded to spend the same.
However, Sandiganbayan Associate Justice Edgardo Caldona with the concurrence of Chairperson Efren De La Cruz and Associate Justice Geraldine Faith Econg ruled that given the facts the Office of the Ombudsman failed to prove that Degamo caused undue injury to any part; gave unwarranted benefits or advantage to a private party.
